Personenbezogene Daten

Personal Data Personal data are data about your person. These include your name, address, and email address. You do not have to disclose any personal data to visit our website. In some cases, we need your name and address as well as further information to provide you with the desired service.

The same applies if we supply you with information material on request or if we answer your inquiries. In these cases, we will always point this out to you. Furthermore, we only store the data that you have automatically or voluntarily transmitted to us.

If you use one of our services, we generally collect only the data necessary to provide you with our service. We may ask you for further information, which is voluntary. Whenever we process personal data, we do so to provide you with our service or to pursue our commercial objectives.

Contact

When contacting us (e.g., via contact form, email, telephone, or social media), the information provided by the requesting persons is processed to the extent necessary to respond to the contact requests and any requested measures. The response to contact requests within the framework of contractual or pre-contractual relationships is carried out to fulfill our contractual obligations or to respond to (pre)contractual requests and otherwise on the basis of legitimate interests in responding to the requests.

Automatically Stored Data

Server Log Files

The provider of these pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

    • Date and time of the request
    • Name of the requested file
    • Page from which the file was requested
    • Access status (file transferred, file not found, etc.)
    • Used web browser and operating system
    • Complete IP address of the requesting computer
    • Transferred data volume

This data is not merged with other data sources. The processing is carried out in accordance with Art. 6 Abs. 1 lit. f DS-GVO based on our legitimate interest in improving the stability and functionality of our website. For technical security reasons, especially to defend against attempted attacks on our web server, this data is stored by us for a short period. It is not possible for us to draw conclusions about individual persons based on this data. After no more than seven days, the data is anonymized by shortening the IP address at the domain level, so that it is no longer possible to establish a link to individual users. The data is also processed in anonymized form for statistical purposes; a comparison with other data sets or a transfer to third parties, even in excerpts, does not take place.

Cookies

When you visit our websites, we may store information on your computer in the form of cookies. Many cookies contain a so-called cookie ID. A cookie ID is a unique identifier of the cookie. It consists of a string of characters through which websites and servers can be assigned to the specific internet browser in which the cookie was stored. This allows the visited websites and servers to distinguish the individual browser of the affected person from other internet browsers that contain other cookies. A specific internet browser can be recognized and identified using the unique cookie ID.

By using session cookies, the responsible party can provide users of this website with a user-friendly service that would not be possible without the setting of cookies. Without consent, we only use technically necessary cookies on the legal basis of legitimate interest in accordance with Art. 6 Abs. 1 lit. f DS-GVO.

We only use personal cookies to improve our website or for marketing/advertising purposes with your consent. On your first visit, you can voluntarily agree to tracking or analysis via the displayed cookie banner. If applicable, your data will be passed on to partners or third-party providers. These cookies are only stored if you explicitly agree, and the legal basis is then your consent in accordance with Art. 6 Abs. 1 lit. a DS-GVO in conjunction with § 25 Abs.1 TTDSG. You can change your settings for the use of cookies here at any time: Cookie-Settings

For what purposes and on what legal basis are the data processed?

We process your data in accordance with the provisions of the General Data Protection Regulation (DS-GVO) and the Federal Data Protection Act 2018 in its current version:

    • To fulfill (pre-)contractual obligations (Art. 6 Abs. 1 lit. b DS-GVO):
The processing of your data is carried out for the execution of contracts online or at our business location. The data is particularly processed during business initiation and during the execution of contracts with you.
    • To fulfill legal obligations (Art. 6 Abs. 1 lit. c DS-GVO):
Processing your data is necessary for the purpose of fulfilling various legal obligations, e.g., from the Commercial Code or the Tax Code.
    • To safeguard legitimate interests (Art. 6 Abs. 1 lit. f DS-GVO):
Based on a balance of interests, data processing may take place beyond the actual fulfillment of the contract to safeguard legitimate interests of us or third parties. Data processing to safeguard legitimate interests occurs, for example, in the following cases:
      • Advertising or marketing (see No. 4),
      • Measures for business management and further development of services,
      • Maintaining an internal customer database to improve customer service,
      • In the context of legal prosecution,
      • Sending non-promotional information and press releases.
    • If you have given us consent to process your data (Art. 6 Abs. 1 lit. a DS-GVO or Art. 9 Abs. 2 lit. a DS-GVO for processing special categories of personal data).

Processing of personal data for advertising purposes

You can object to the use of your personal data for advertising purposes at any time, either in total or for individual measures, without incurring any costs other than the transmission costs according to the basic rates.

We are legally entitled under § 7 Abs. 3 UWG to use the email address you provided at the time of contract conclusion for direct advertising for our own or similar services. You will receive this information from us regardless of whether you have subscribed to a newsletter.

If you do not wish to receive such recommendations by email from us, you can object to the use of your address for this purpose at any time without incurring any costs other than the transmission costs according to the basic rates. A notification in text form is sufficient for this. Of course, every email always contains an unsubscribe link.

Who receives my data?

If we use a service provider in the sense of order processing, we remain responsible for the protection of your data. All order processors are contractually obligated to treat your data confidentially and to process it only within the scope of service provision. The order processors commissioned by us will receive your data if they need the data to fulfill their respective service.

Your data will be processed in our customer database. The customer database supports the improvement of the data quality of the existing customer data (duplicate cleansing, moved/deceased indicators, address correction) and enables enrichment with data from public sources. These data are made available to the companies within the group as necessary for contract processing. The storage of customer data is company-related and separate. In the event of a legal obligation and in the context of legal prosecution, authorities and courts as well as external auditors may be recipients of your data. Furthermore, for the purpose of contract initiation and fulfillment, insurance companies, banks, and other service providers may be recipients of your data.

If consent has been requested, the processing is carried out exclusively on the basis of Art. 6 Abs. 1 lit. a DS-GVO and § 25 Abs. 1 TDDDG, insofar as the consent includes the storage of cookies or access to information in the user’s terminal device (e.g., device fingerprinting) within the meaning of the TDDDG. The consent can be revoked at any time.

Our Hoster will only process your data to the extent necessary to fulfill its service obligations and follow our instructions regarding this data.

Right to Restriction of Processing:

You can request the restriction of the processing of your data from us if

Where technically feasible, you can request that we directly transfer your data to another controller.

Right to Object:

If we process your data based on legitimate interest, you can object to this data processing at any time; this also applies to profiling based on these provisions. We will then no longer process your data unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights, and freedoms, or the processing serves the assertion, exercise, or defense of legal claims. You can object to the processing of your data for direct marketing purposes at any time without giving reasons.
